DUI for the first time – BAC ranges from 0.08 to 0.149 percent

Standard DUIs involving alcohol are found in ARS 28-1381 (A)(1) and (A)(2) of the Arizona DUI legislation (2). These two sections detail the various ways you can be charged with a standard DUI.

You can be charged with a DUI under paragraph A1 if you have actual physical control operating a vehicle after ingesting any amount of alcohol or drugs.

This clause authorizes the police to charge you with a DUI even if you have a little amount of alcohol or drugs in your system or do not have the results of a chemical test.

If a chemical test within two hours of your arrest shows a BAC of 0.08 percent to 0.149 percent, the police can arrest you for DUI under subsection (A)(2). This is Arizona’s per se DUI law, which means that if your blood alcohol concentration (BAC) falls within this range, there will be a presumption that you are impaired by drinking.

In most DUI instances, police officers will cite both subsections. You will only be punished for a single DUI, even if you are convicted under each part.

All DUIs, including first-time standard DUIs, are handled harshly under Arizona DUI regulations. If you are found guilty, you will be sentenced to at least 10 days in prison. The court can, however, defer the sentence for nine days if an alcohol assessment and any prescribed lessons are completed.

Extreme DUI – Blood Alcohol Concentration 0.15% to 0.199%

If your blood alcohol concentration (BAC) is 0.15 percent to 0.199 percent within two hours of your arrest, you will be charged with an extreme drunk driving crime under Arizona law, according to ARS 28-1382(A) (1).

If this is your first DUI violation in the last seven years, you could face the following penalties if you are convicted:

  • At the very least, 30 days in prison
  • A total of $2,500 in fines and fees
  • Suspension of your driver’s license for a minimum of 90 days
  • Installation of an IID is required for a period of 12 months.
  • Assessment for substance abuse and any classes that may be recommended
  • A five-year probationary sentence is possible.
  • Your license has been docked eight points.
  • SR-22 insurance for traffic survival school

You will be sentenced to 120 days in prison if you receive a second extreme conviction. You’ll also face fines and fees totalling at least $3,700, your driver’s license will be suspended for one year, and you’ll be required to install an IID in your car for the next 18 months.

In addition to performing 30 hours of community service, you will be required to submit to a substance addiction examination, and any treatment that may be suggested.

Super-Extreme DUI – Blood Alcohol Concentration of 0.20% or Higher

A super-extreme DUI can be charged in Arizona if your BAC is at least 0.20 percent, according to ARS 28-1382(A) (2). If you are guilty of a super-extreme offense for the first time, you will be sentenced to 45 days in prison.

You will also be required to pay at least $3,000 in penalties and costs, and your driver’s license will be suspended for at least 90 days. You will be required to install an IID on your own dime, attend traffic survival school, and maybe complete at least 30 hours of community service.

The court has the authority to impose the following potential punishments for a second super-extreme conviction:

  • A six-month prison sentence
  • A total of $4,700 in fines and penalties
  • IID for 24 months after a 12-month suspension of your driver’s license
  • 30 hours of community service is required.
  • A five-year probationary sentence is possible.
  • Assessment and classes for substance abuse
  • School of Traffic Survival

Driving Under the Influence of Drugs

Under Arizona DUI laws, you can be charged with a drugged DUI per ARS 28-1381(A)(3) if a blood or urine test completed within two hours of your arrest reveals the presence of any of the drugs found in ARS 13-3401, including marijuana, cocaine, heroin, methamphetamines, controlled substances without a prescription, and many others.

If you are convicted of a first drugged DUI in Arizona, you will face the penalties for a regular DUI. However, you might not be ordered to install an IID in your car since it is not required for drugged driving cases.

Arizona Felony Aggravated DUI Charges

In one of the following five scenarios, the police can charge you with aggravated DUI:

  • Getting a DUI while your driver’s license is limited, revoked, or suspended is a serious offense.
  • Getting a DUI while your vehicle is required to have an IID fitted
  • Getting a DUI while driving with someone under the age of 15
  • After seven years, being charged with a third offense
  • Getting a DUI for driving in the wrong direction

It is a Class 6 felony if you are convicted of a DUI while someone under the age of 15 was in your vehicle. Class 4 felony charges are the other forms of aggravated DUIs.

A first aggravated DUI in Arizona is a Class 4 felony that carries a minimum four-month prison term and up to ten years of probation.

The court will also compel you to pay at least $4,700 in penalties and assessments, as well as suspend your license for a year. For the next 24 months, you must install an IID in your vehicles and complete an alcohol assessment and any prescribed treatment.

I was really in trouble and I wentto Rosenstain Law firm because of it was close by my home. Then I met with Omar and he checked my case and told me all of the things gonna happen .
